    Combined Firms Create Powerhouse Insurance Practice with 120 Attorneys Dedicated to Serving the Insurance Industry

    Chicago and Los Angeles — September 2, 2014 — Barger & Wolen and Hinshaw & Culberston, a national law firm with 460 lawyers in 22 offices around the country, announced today they will combine forces. The merger creates one of the largest insurance law practices in the United States with 120 full-time attorneys dedicated to providing legal counsel to insurance companies and financial services firms that shape the insurance industry.

    The partner votes took place on August 28, 2014, and the merger will become effective on October 1, 2014. The combined firm will keep the name Hinshaw & Culbertson and have over 500 attorneys in 11 states as well as London.

  • Jun 27, 2014 - Recent Victory on Behalf of Medical Supplement Insurers against California Department of Insurance
    As a result of the filing of a Writ of Mandate and Declaratory Relief Action by Barger & Wolen's Senior Regulatory Counsel Robert W. Hogeboom and Litigation Partner John Holmes, the California Department of Insurance (“CDI”) agreed to cease and desist its practice of requiring insurers to file and pay fees on insurer notices to policyholders policyholder “notices” in connection with Medicare supplement policies. Further, the CDI agreed to refund to each of the plaintiff insurers in the suit all filing fees that had been paid to the CDI since 2012.

    The action was filed on behalf of five Torchmark Group insurers who issue Medicare supplement insurance policies in California. Under California Insurance Code (“CIC”) § 10192.14(c), each insurer is required to submit an annual rate filing for each Medicare supplement product to demonstrate compliance with a minimum lifetime loss ratio requirement.     District Court Reaffirms “Genuine Dispute Doctrine,” Precludes Bad Faith Claim

    On November 29, 2013, United States District Court Judge Margaret M. Morrow granted summary judgment to Barger & Wolen LLP client Mitsui Sumitomo Insurance Company of America in Lucky Leather Inc. v. Mitsui Sumitomo (Case No. CV12-09510-MMM). Lead attorneys Stephen Klein and Peter Sindhuphak were successful in convincing the Court that the insured had failed to raise a triable issue that benefits under the Mitsui Sumitomo policy were owed.   • Sep 26, 2013 - Robert Hogeboom to speak at ACLHIC 36th Annual Roundtable
    Robert Hogeboom will present at the Association of California Life and Health Insurance Companies 36th Annual Round Table Conference on September 26, 2013. He will be addressing the newly proposed California Department of Insurance Hazardous Financial Conditions; Corrective Actions Regulations.

    The regulations, which were noticed for hearing on June 21, 2013, create 20 different standards under which the commissioner may determine that insurers doing business in California may be in a hazardous condition and order the insurer to follow one or more of 12 stated corrective actions. Mr. Hogeboom testified on the regulations on August 7, 2013, on behalf of the Pacific Association of Domestic Insurance Companies and the National Association of Mutual Insurance Companies questioning the commissioner's authority to avoid the legislature and proceed thru the regulation adoption process. Other speakers on the panel include the Assembly and Senate Chief Consultants as well as several other legislative staff members who will be addressing other legislative topics of interest to ACHLIC insurer members.

    The California Court of Appeal for the Second Appellate District (Division Three) recently issued its ruling in .(JavaScript must be enabled to view this email address), affirming the trial court’s determination on summary judgment that Appellant Erin Beaumont-Jacques, a former District Manager for five affiliated insurers (“Farmers”) was an independent contractor, not an employee. The case has been certified for publication.

    The authors of this article represented Farmers in this case both at the trial court and the appellate level.

    Today's verdict is a complete vindication for Blue Shield of California. It means we acted properly every step of the way. It means that our underwriting procedures were fair and complete, our application was clear, and we acted in good faith. There was no post-claims underwriting. The evidence of deceit by the Haileys was overwhelming. This decision proves that Blue Shield of California had every right to rescind the Haileys' coverage.

    Los Angeles, CA – In an administrative proceeding before California Insurance Commissioner Steve Poizner, Barger & Wolen partners Kent R. Keller and Stephen C. Klein obtained a key win on appeal for client Virginia Surety against the California Insurance Guarantee Association (CIGA), File No. CIGA-07-1.

    In an order that is effective February 12, 2009, California’s Insurance Commissioner Steve Poizner has adopted the decision of Administrative Law Judge David R. Harrison declaring “The Credit Refund Rules CIGA Adopted at its November 15, 2007 Board Meeting Were Invalid.”

    Barger & Wolen partners John S. Pierce, Robert G. Levy, Larry M. Golub, Dawn N. Valentine and Travis Wall, have co-authored a book published by Aspen Publishing, updated in 2008, entitled Defending the Insured. The book is a practical guide for insurers and defense counsel concerning issues that arise nationwide in providing a defense to insureds pursuant to liability policies. Topics covered include the nature of rights and duties in the tripartite defense relationship, the use of independent counsel and allocation issues between the insurer and the insured. First published in 2004, the publication is the first of its kind to provide a state-by-state guide to legal professional ethics issues that impact the insurance industry, including the use of billing guidelines, staff counsel and legal fee audits.
